What is mediation?
Mediation is the process where a trained neutral party helps to bring an agreement between two or more parties.

The process is easily followed. The role of the mediator is to guide the process of the discussions with the end result of reaching a settlement agreement or resolution to an issue.

One of the most important tools of the mediator is establishing the ground rules for the discussion and making sure everyone uses them in a fair and equal manner..

Using the process of mediation, equal time and opportunity is allowed for both parties of the dispute to be heard. Each party is given as much time as they need to fully discuss their side of the issue.

As the process progresses, the mediator will help the parties to think through their positions, what end result the parties want to achieve, and ensure that all parties participate in preparing a settlement agreement as one is reached.

Who uses mediation?
Mediation is used in business disputes, employee/employer disputes, small claims court, and family court. Husbands and wives use mediation to resolve differences and avoid divorce.

Another use of mediation, which is in growing demand, is to help "bridge the
gap" between parents and teens. There are other ways that mediation is proving to be beneficial; these are just to name a few. Mediation can be useful in almost any disagreement to reach a common resolution.

What is the difference between court
and mediation?
In traditional court when the parties leave
the courtroom, one party usually 'wins'
and the other party usually 'loses'. In reality,
it is not unusual for both parties to feel as if
they 'lost' after hearing the court's decision.

In mediation, the goal is for both parties to
leave negotiations with the winning feeling.
